The goal of an engineering service agreement is to highlight the standards and practices both parties will abide by during the performance of professional engineering design services. The ESA sets deliverables for what will be produced, how it will be produced, when it will be produced, how much will it cost, and how those fees will be paid. In the performance of professional engineering services, the ESA sets liabilities and protections for both parties where necessary, defining obligations, property rights, default standards, acceptance & rejection, and delivery liabilities.
The benefit of an ESA is the reliability and protection it provides across both parties. The ESA sets liabilities and responsibilities for both parties which they abide by during the performance of professional engineering services. It ensures deliverables are created to agreed-upon standards, one time, and for agreed-upon compensation. The ESA provides ample protection for both the engineer and client, ensuring payment is delivered on time, but either party may hold the other responsible or terminate for breach of contract.
The goal of this document is to provide insight into our contract engineering design process from ideation to full-scale production including EOL. It highlights how EM supports you along the way in addition to walking through our engineering service agreement, going into depth clause my clause, giving a better understanding of how it worked to protect both parties.
